- Overview of Contemplated Contract:
The high-level details of the equipment to be provided under the contemplated contract are generally described below:
- Flow Analyzer Equipment shall include: sampler with 140 sample positions, diluter station, module holder with integrated electronics, ammonia analysis module, nitrate+nitrate analysis module, ortho phosphate analysis module, dual channel digital photometer detector head, rinsing valve, auto 3-way switching valve, accessories, filters, flow cells.
- Equipment to be supplied with one-year warranty.
- Maximum Contract Value:
- Rationale for Contemplating a Direct Award:
- The District believes, but cannot strictly prove, the Supplier is the only vendor that can provide the equipment, plus associated spare parts and required training for the equipment within the contemplated total contract value, because:
- The District has an existing older analyzer system with the same manufacturer, and is therefore able to use existing spare parts from this older system (related to tubing, mixing cells, pumps and platen), without purchasing a new set of spare parts for the new equipment.
- The District does not need to incur cost of additional training in the new equipment, because District staff are already familiar with operating systems of this manufacturer.
- Chemistries available for this equipment are the same as what the District currently possesses.

- Submission of Challenges:
- Any Challenge submitted to this NOI is required to be in English and must be submitted in writing via email to the Official Contact only. The ‘Official Contact’ is: Andy Brennan – Purchasing Agent, Regional District of Central Okanagan. Email Address to be used is: purchasing@rdco.com
- Challenges to the NOI must be received by the Official Contact, at the email address above, before the NOI Closing Date and Time. Challenges received after the NOI Closing Date and Time will be disregarded.
- Challenges to this NOI must include the following information at a minimum:
- The legal name of the individual/organization submitting the Challenge.
- The reason for the Challenge.
- A statement confirming that the individual/organization submitting the Challenge can supply equivalent equipment, spare parts, and services at a price which is lower than the contemplated maximum contract value. Note: Pricing for the equipment and service must include for all of the District’s cost for management and administration of a change to a new equipment provider.
- Signature and date of the individual or officer of the organization submitting the Challenge.
- Review of Challenges:
- If the District receives a Challenge to the NOI before the Closing Date and Time, the District must assess whether the challenge is justified; and whether a public Request for Proposals process should be undertaken.
- If no Challenges to the NOI are received prior to the Closing Date and Time or no Challenge is submitted which meets the requirements outlined in a) iii. that, in the sole opinion of the District, warrants the District issuing a public Request for Proposals for the contemplated contract; then the District may commence contract negotiations with the Supplier for the equipment described in the NOI.
